TERMS OF SERVICE
Introduction
Welcome to FLEART. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and FLEART, operated by Ramzi Farzaliyev ("FLEART", "we", "us", "our"), governing your access to and use of the FLEART platform, including all associated services, features, tools, APIs, content, and functionality available at appfleart.com and any related subdomains or applications (collectively, the "Platform").
Please read these Terms carefully before creating an account or using any part of the Platform. By accessing or using FLEART, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using FLEART on behalf of an organization, company, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" shall include both you individually and that entity.
If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform.
1. About FLEART
1.1 Platform Description
FLEART is a cloud-based, AI-powered content creation and distribution platform designed to consolidate the entire content production lifecycle — from generation to publication — within a single, unified ecosystem. The Platform enables users to produce professional-grade visual and video content using integrated artificial intelligence models, manage and organize their content library, and schedule and distribute content directly to social media platforms without leaving the FLEART interface.
FLEART is not a single AI tool. It is a comprehensive AI production ecosystem that combines:
- Creation Layer: AI-powered image generation, video generation, UGC (user-generated content) simulation, product scene creation, and AI-assisted editing
- Studio & Dashboard Layer: Content management, campaign organization, credit tracking, project-based workflows, and operational oversight
- Distribution Layer: Social media account integration, content scheduling, calendar-based planning, and automated publishing

1.3 Nature of Service
FLEART operates as an interface layer between users and third-party artificial intelligence model providers. When a user submits a prompt or instruction within the Platform, that input is transmitted via API to one or more third-party AI model providers, which generate and return the output. FLEART facilitates this process but does not independently generate AI content. As such, the quality, style, and nature of generated outputs are determined by the capabilities and policies of the underlying AI models.
2. Acceptance of Terms
2.1 Agreement to Terms
By accessing the Platform, registering an account, purchasing credits, or using any feature of FLEART, you confirm that:
- You have read and understood these Terms in full
- You agree to be legally bound by these Terms
- You meet all eligibility requirements set forth in Section 3
- You consent to the collection and use of your data as described in our Privacy Policy
2.2 Updates to Terms
FLEART reserves the right to modify, amend, or update these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this document. For material changes, we may also notify users via email or a prominent notice on the Platform. Your continued use of the Platform following the posting of updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Platform.
2.3 Additional Policies
These Terms should be read in conjunction with the following additional policies, which are incorporated by reference:

In the event of any conflict between these Terms and any additional policy, these Terms shall prevail unless the additional policy expressly states otherwise.
3. Eligibility and Account Registration
3.1 Age Requirement
You must be at least 18 years of age to access or use FLEART. By using the Platform, you represent and warrant that you are 18 years of age or older. If FLEART becomes aware that a user is under the age of 18, the account will be immediately terminated.
3.2 Geographic Availability
FLEART is a globally accessible platform and is not restricted to any specific country or region. However, it is your responsibility to ensure that your use of the Platform complies with all applicable laws and regulations in your jurisdiction. FLEART makes no representation that the Platform is appropriate or legally permitted in all locations.
3.3 Account Creation
To access the full features of the Platform, you must register for an account. During registration, you agree to:
- Provide accurate, complete, and current information
- Maintain and promptly update your account information to keep it accurate
- Use a valid email address that you regularly monitor
- Create a strong and secure password and keep it confidential
You are solely responsible for all activities that occur under your account, whether or not authorized by you. FLEART cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
3.4 Account Security
If you become aware of any unauthorized use of your account or any other security breach, you must notify FLEART immediately at support@appfleart.com. FLEART will not be liable for any loss resulting from unauthorized use of your account prior to such notification.
3.5 One Account Per User
Each user is permitted to maintain one account. Creating multiple accounts to circumvent restrictions, abuse the credit system, or exploit promotional offers is strictly prohibited and may result in the permanent termination of all associated accounts.
4. Platform Features and Services
4.1 AI Content Generation
FLEART provides access to a range of AI-powered content generation capabilities, including but not limited to:
- Text-to-image generation
- Text-to-video generation
- Image-to-video generation
- Consistent character generation
- Product showcase and scene generation
- UGC-style content generation
- AI-assisted editing and post-production tools
These features are made available through integrations with third-party AI model providers. The availability of specific models and features may change over time as providers update their offerings or policies.
4.2 Content Management Dashboard
The FLEART dashboard provides users with tools to organize, manage, and review their generated content, including campaign folders, project management tools, credit and usage tracking, and content history.
4.3 Social Media Scheduling and Publishing
FLEART enables users to connect their social media accounts and schedule content for automated publishing. This feature acts as an authorized intermediary between the user and the social media platform. FLEART publishes content strictly at the user's instruction and on the user's behalf.
4.4 Feature Availability
FLEART strives to maintain continuous availability of all Platform features. However, we do not guarantee uninterrupted access to any specific feature. Features may be temporarily unavailable due to maintenance, technical issues, third-party service disruptions, or updates. FLEART reserves the right to modify, suspend, or discontinue any feature at any time with or without notice.
5. Credits, Payments, and Billing
5.1 Credit-Based System
Access to AI generation features on FLEART is governed by a credit system. Users must purchase credits in advance to use AI-powered tools. Each type of AI action (e.g., image generation, video generation) consumes a specified number of credits, which is clearly communicated within the Platform at the time of use.
5.2 Credit Packages
Credits are available for purchase in predefined packages. The current pricing, package options, and credit values for each action are displayed on the FLEART pricing page at appfleart.com/pricing. Prices are subject to change, and the price applicable to a purchase will be the price displayed at the time of that purchase.
5.3 Credit Expiry
Credits are tied to the billing period in which they are purchased. Unused credits do not roll over to the following month and will expire at the end of the applicable billing period. Users are encouraged to review their credit balance regularly and plan usage accordingly. FLEART will not issue refunds or extensions for expired credits.
5.4 Non-Transferability
Credits are personal to the account for which they were purchased. Credits may not be transferred, gifted, sold, or shared with any other user or account under any circumstances.
5.5 Payment Processing
All payments on the FLEART Platform are processed by Paddle, our authorized Merchant of Record and payment processing partner. By completing a purchase, you agree to Paddle's Terms of Service and Privacy Policy in addition to these Terms. Paddle handles all billing, invoicing, tax compliance, and payment security on behalf of FLEART.
5.6 Taxes
As Paddle acts as the Merchant of Record, applicable taxes (including VAT, GST, and sales tax) are calculated and collected by Paddle in accordance with the tax laws of your jurisdiction. The final price displayed at checkout will include any applicable taxes.
5.7 Failed Payments
If a payment fails or is declined, access to credit-dependent features may be restricted until the payment issue is resolved. FLEART is not responsible for any disruption to service resulting from payment failure.
5.8 Refunds
All credit purchases are subject to our Refund Policy available at appfleart.com/refund. In general, credits are non-refundable once purchased. However, exceptions may be considered in limited circumstances as described in the Refund Policy.
6. Intellectual Property
6.1 User-Generated Content
All images, videos, and other content generated by you through your use of FLEART's AI tools are owned exclusively by you, the user. FLEART does not claim any ownership rights over content produced using your prompts and credits.
You are solely responsible for ensuring that your use of any generated content complies with applicable intellectual property laws, the terms of the relevant AI model providers, and the platform policies of any third-party service on which you publish such content.
6.2 License Granted to FLEART
By using the Platform, you grant FLEART a limited, non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your content solely for the purposes of providing the services described in these Terms. This includes displaying content in your dashboard, processing it through AI models, and transmitting it to social media platforms on your behalf. This license terminates upon deletion of your content or account, subject to the data retention period described in Section 10.
6.3 FLEART Platform Intellectual Property
The FLEART Platform — including but not limited to its name, logo, branding, interface design, codebase, architecture, documentation, marketing materials, and all associated intellectual property — is the exclusive property of Ramzi Farzaliyev and is protected by applicable intellectual property laws. You are granted no rights or licenses in respect of FLEART's intellectual property other than the limited right to use the Platform as described in these Terms.
You agree not to reproduce, duplicate, copy, sell, resell, reverse-engineer, decompile, or exploit any portion of the Platform or its intellectual property without our express prior written consent.
6.4 Feedback
If you provide FLEART with suggestions, feedback, ideas, or recommendations regarding the Platform ("Feedback"), you grant FLEART a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and commercialize that Feedback in any manner without any obligation to you.
7. Third-Party AI Models and Services
7.1 Third-Party Providers
FLEART integrates with third-party AI model providers via API to deliver content generation features. These providers operate independently of FLEART and are governed by their own terms of service, usage policies, and content guidelines.
7.2 No Liability for Third-Party Outputs
FLEART does not control, endorse, or assume responsibility for the outputs generated by third-party AI models. The accuracy, appropriateness, legality, and quality of AI-generated content are subject to the capabilities and limitations of the underlying models. FLEART makes no warranties regarding the suitability of any AI-generated output for any specific purpose.
7.3 Compliance with AI Provider Policies
By using AI generation features on FLEART, you agree to comply with the usage policies of the relevant AI model providers. FLEART reserves the right to restrict access to specific models or features if required by a provider's policy changes.
7.4 Third-Party Social Media Platforms
FLEART's social media scheduling and publishing features rely on the APIs of third-party social media platforms. FLEART does not guarantee the continuous availability of these integrations, as they are dependent on the policies and API access decisions of each platform. Changes to a social media platform's API or policies may affect the functionality of FLEART's publishing features.
8. Prohibited Conduct
You agree that you will not, under any circumstances, use the Platform to:
8.1 Intellectual Property Violations
- Upload, submit, or generate content that infringes upon the copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any third party
- Use AI-generated content in a manner that violates the intellectual property terms of the AI model provider that produced it
8.2 Unauthorized Access and Security Violations
- Attempt to gain unauthorized access to any other user's account, to FLEART's backend systems, databases, or infrastructure, or to any third-party system connected to the Platform
- Use any automated means, including bots, crawlers, scrapers, or data mining tools, to access, extract, or collect data from the Platform without express written authorization from FLEART
- Introduce malware, viruses, trojans, worms, or any other harmful or disruptive code into the Platform or its connected systems
- Perform any action that places an unreasonable or disproportionate load on the Platform's infrastructure
8.3 Account Abuse
- Create multiple accounts to circumvent access restrictions, exploit promotions, or abuse the credit system
- Transfer, sell, or share your account credentials with any third party
- Misrepresent your identity or impersonate any person, company, or organization
8.4 Platform Misuse
- Use the Platform for any purpose that violates applicable local, national, or international laws or regulations
- Use the Platform to send unsolicited communications, spam, or promotional messages
- Use the Platform in any way that could damage the reputation, interests, or rights of FLEART or its users
Violation of any of the above may result in immediate suspension or permanent termination of your account, without refund, and may be reported to relevant law enforcement authorities where appropriate.
10. Account Termination and Data Retention
10.1 Termination by the User
You may terminate your account at any time by accessing your account settings or by contacting FLEART at support@appfleart.com. Upon termination, your access to the Platform will be revoked.
10.2 Termination by FLEART
FLEART reserves the right to suspend or permanently terminate your account, with or without prior notice, if:
- You breach any provision of these Terms
- We are required to do so by applicable law or regulation
- We reasonably believe that your use of the Platform poses a risk to FLEART, other users, or third parties
- Your account has been inactive for an extended period
In cases of termination due to a breach of these Terms, no refund will be issued for any unused credits.
10.3 Data Retention Following Termination
Upon account deletion or termination, your content, data, and account information will be retained on our servers for a period of 30 days. During this period, you may contact us to request recovery of your data. After this 30-day period, all data associated with your account will be permanently and irreversibly deleted from our systems. FLEART is not liable for any loss of data following this deletion.
10.4 Survival
Certain provisions of these Terms will survive termination, including but not limited to: Intellectual Property (Section 6), Limitation of Liability (Section 12), Disclaimer of Warranties (Section 11), and Governing Law (Section 14).
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLEART EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; AND WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT GENERATED THROUGH THE PLATFORM.
No advice or information, whether oral or written, obtained by you from FLEART shall create any warranty not expressly stated in these Terms.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLEART AND RAMZI FARZALIYEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES; LOSS OF DATA OR CONTENT; REPUTATIONAL DAMAGE; OR COSTS OF PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF FLEART HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FLEART'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE TOTAL AMOUNT PAID BY YOU TO FLEART IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless FLEART, Ramzi Farzaliyev, and any affiliated parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, your violation of any applicable law or regulation, your infringement of any third-party rights including intellectual property rights, or any content you submit, publish, or distribute through the Platform.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any disputes arising out of or in connection with them, including non-contractual disputes, shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
14.2 Jurisdiction
You agree that any legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14.3 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact FLEART at support@appfleart.com and attempt to resolve the dispute informally. FLEART will make reasonable efforts to resolve the matter within 30 days of receiving written notice.
15. General Provisions
15.1 Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and FLEART with respect to your use of the Platform and supersede all prior or contemporaneous agreements, understandings, or representations.
15.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.
15.3 Waiver
FLEART's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision unless acknowledged and agreed to in writing.
15.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without the prior written consent of FLEART. FLEART may assign its rights and obligations under these Terms without restriction.
15.5 Force Majeure
FLEART shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, third-party service outages, or other events of force majeure.

9. Social Media Integration and Publishing
9.1 Authorization
By connecting a social media account to FLEART, you authorize FLEART to access your account for the purpose of scheduling and publishing content on your behalf, strictly at your instruction.

FLEART acts solely as a technical intermediary for content distribution. We are not responsible for the removal, restriction, or penalization of your social media accounts by third-party platforms as a result of content published through FLEART.
